Debt recovery in Kuwait begins with proof of the obligation, the correct debtor, the amount due and the date payment became payable. An unpaid invoice is useful, but the underlying contract, delivery or service records and payment history may be equally important. The appropriate recovery route depends on the documents and whether the debt is disputed.

Build the debt file before making a demand

  • Identify the debtor: use the correct individual or company name and supporting records. A trading name, branch and shareholder are not automatically interchangeable.
  • Show the obligation: collect contracts, orders, acknowledgements and relevant communications.
  • Show performance: include delivery notes, acceptance records, completed work or other evidence explaining why payment is owed.
  • Reconcile the balance: deduct payments, returns, credits and agreed adjustments.
  • Record maturity: state when payment became due and which contractual condition or event triggered it.

A useful statement of account

Create a dated schedule containing the invoice or transaction reference, original amount, due date, amounts received and balance. Attach the document supporting each entry. If the debt is in a foreign currency, identify the agreed currency and any contractual conversion provision rather than silently converting it.

For a personal loan or advance, preserve transfers and communications explaining its purpose and repayment terms. A transfer alone may show movement of money without resolving whether it was a loan, a gift, an investment or payment for another obligation.

Demand, payment order or ordinary claim?

A formal demand can clarify the amount and supporting basis and may form part of the required procedure. The payment-order route is subject to statutory conditions; it is not available for every unpaid account. Whether it applies requires review of matters such as the written evidence, maturity and certainty of the debt, together with the applicable procedural requirements.

Where the obligation, performance or amount is genuinely disputed, a claim may require fuller evidence and potentially expert examination. The correct procedural route should be selected before filing, not chosen merely because it appears faster.

Settlement and enforcement are separate stages

A repayment agreement should identify the parties, admitted balance, instalment dates and the legal consequences of non-payment. Review its enforceability and effect on the original documents before accepting a release, replacing security or returning originals.

Obtaining a judgment does not guarantee collection. Enforcement depends on the enforceable instrument, available assets and the applicable procedures. Asset-preservation measures, where legally available, require their own conditions; they should not be promised in every debt case.

When the file already contains an overseas judgment

A claim to establish a debt and an application to recognise or enforce a foreign judgment are different tasks. If a judgment already exists abroad, provide the full judgment, evidence of its status and the procedural documents. Review recognition and enforcement requirements before starting a duplicate claim.

Frequently asked questions

Is an invoice enough to win a debt case?

It depends on what is contested and what the invoice proves alongside the contract, performance and payment records. No single document guarantees recovery.

Is a company owner automatically liable for the company’s debt?

No. The company’s legal form, the obligation and any guarantee or separate basis of liability must be examined.

Can I claim interest, penalties and legal costs automatically?

Each additional amount needs its own contractual or legal basis and assessment of recoverability. Do not simply add a standard percentage to every claim.
