Custody is one of the most sensitive issues in family law. After a custody ruling is issued, new circumstances may arise that prompt one party to seek to revoke custody from the other. In this article, we explain when custody is revoked in Kuwait and the legal conditions for doing so.


️ First: What are the reasons for dropping custody?

Kuwaiti law allows the father or any interested party to request the revocation of custody when one of the following conditions is met:

  1. The marriage of the custodian to a foreigner.
  2. Proof of neglect or abuse.
  3. Unsuitability of the dwelling or environment.
  4. Moving without the permission or knowledge of the other party to a distant location.
  5. Mental or psychological illness that harms the child in custody.
  6. Constant travel or continuous absence from the child in custody.
